Welcome to GH Transportation LLC. These Terms of Service ("Terms") govern your use of our website at ghtransportation-llc.com ("the Site") and any related online services we provide. Please read them carefully.

1. Acceptance of terms

By accessing or using the Site, submitting a form, or otherwise interacting with us through this Site, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Site.

You must be at least 18 years old to use the Site or submit any information through it.

2. About GH Transportation LLC

GH Transportation LLC is an authorized motor carrier operating under US DOT #4186203 and MC #1612573, based at 259 Pacific St, Bridgeport, CT 06604. We provide expedited freight transportation services nationwide.

3. Use of the website

You may use the Site only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the Site in any way that violates applicable federal, state, local, or international law or regulation
• Submit false, misleading, or fraudulent information through any form
• Attempt to gain unauthorized access to any portion of the Site, our hosting infrastructure, or related systems
• Interfere with or disrupt the operation of the Site, including through bots, scrapers, denial-of-service attempts, or automated submissions
• Use the Site to send spam, harassing, or abusive communications
• Reverse engineer, decompile, or extract source code from the Site beyond what is permitted by law
• Copy, reproduce, or republish substantial portions of the Site without our express written permission

4. Driver applications and broker inquiries

Driver applications

Submitting a driver application through our Site does not create an employment relationship, contractor relationship, or any binding offer. All applications are reviewed by our team, and we may follow up with you for additional information, phone screening, or in-person interviews before making any decision. We reserve the right to accept or decline any application at our sole discretion.

Broker freight inquiries

Submitting a freight quote request does not constitute a binding contract for transportation services. Any quote we provide is an estimate based on the information you submit and is subject to confirmation in a written rate confirmation or contract. Actual rates may change based on final freight details, equipment availability, fuel surcharges, accessorials, market conditions, and other factors.

5. SMS text message communications

If you provide your mobile phone number and separately opt in to text messages by checking one or both SMS consent boxes on our driver application or broker inquiry forms, you agree to receive SMS communications from GH Transportation LLC as described in this section.

Our SMS program is offered in two separate consent categories, each independently opt-in:

1. Operational SMS — transactional messages tied to recruiting, dispatch, settlement, and active shipments. Moderate volume.
2. Load Offer / Capacity Bid Broadcasts — high-volume broadcast text alerts of available loads (to drivers) or rate bids (to brokers). Separately consented to so recipients can opt in to operational messages only if preferred.

You may consent to one category, both, or neither. Your choice does not affect any application, employment, or service.

What we may send

• Driver applicants and active drivers:
  • Load offer broadcasts (multiple per day, sent to qualified drivers as loads come in)
  • Dispatch coordination (pickup, delivery, route changes)
  • Operational updates (check calls, ETAs, POD requests)
  • Settlement and pay notifications
  • Recruiting follow-ups and onboarding
  Volume is very high. Opted-in drivers may receive dozens of messages per day during active load posting hours, totaling several hundred messages per month. Daily peaks can exceed 50+ messages.
• Broker partners:
  • Capacity bids and rate offers on posted loads
  • Quote responses and rate confirmations
  • Dispatch and tracking updates, ETAs, POD confirmations
  • Payment notifications and invoice status
  Volume is high during active bidding and shipments — several hundred messages per month during peak operations.

Message rates and your responsibility

Message and data rates may apply per your wireless carrier's plan. GH Transportation LLC does not charge for SMS messages, but your carrier's standard messaging rates may apply. You are responsible for any charges from your carrier.

Opt-out and help

You may opt out of SMS messages at any time:

• Reply STOP to any text message we send (also accepted: UNSUBSCRIBE, CANCEL, END, QUIT)
• Email info@ghtransportation-llc.com with subject "SMS Opt Out"

Consent is voluntary

Your consent to receive SMS messages is not required to apply for employment, request a freight quote, or use any service from GH Transportation LLC. You may withdraw consent at any time without affecting any application, agreement, or service.

Mobile information sharing

Mobile phone numbers and SMS consent data are not shared with third parties or affiliates for marketing or promotional purposes. Mobile information will not be sold, transferred, or licensed to any third-party marketer.

Accurate information

You agree that any mobile phone number you provide is your own and that you have the authority to receive SMS messages at that number. You will notify us promptly at info@ghtransportation-llc.com if your mobile number changes or is no longer in service.

6. Freight quotes and pricing

Quotes provided through the Site or in response to a Site inquiry are:

• Estimates only, not firm commitments, unless documented in a signed rate confirmation
• Valid for the timeframe stated in the quote, or 7 days if not specified
• Subject to verification of freight details, weight, dimensions, and pickup/delivery accessibility
• Subject to availability of appropriate equipment and drivers at the time of dispatch

A binding agreement to transport freight is created only when both parties sign a rate confirmation or other written contract.

7. Carrier services and brokered shipments

Carriage of freight by GH Transportation LLC is governed by:

• The rate confirmation or transportation contract signed between the parties
• Our standard motor carrier terms and conditions, available upon request
• Applicable federal regulations including 49 CFR Parts 370–379, and the Carmack Amendment (49 U.S.C. § 14706) governing carrier liability for loss or damage
• State law not preempted by federal law

Cargo claims must be filed in writing within nine (9) months of delivery (or within nine months of a reasonable time when delivery should have occurred). Lawsuits for cargo claims must be filed within two (2) years and one (1) day of our written disallowance of the claim.

8. Accuracy of information

You agree that information you submit through the Site — whether as part of a driver application or broker inquiry — is accurate, current, and complete to the best of your knowledge. We rely on your information to evaluate applications, generate quotes, and coordinate transportation. Material misrepresentations may result in withdrawal of an offer, termination of services, or other remedies available to us.

9. Intellectual property

The Site, including its design, layout, text, graphics, logos, and code, is owned by GH Transportation LLC and is protected by U.S. copyright, trademark, and other intellectual property laws. The "GH Transportation" name, logo, and any related marks are the property of GH Transportation LLC.

You may not use, copy, reproduce, modify, or distribute any content from the Site for commercial purposes without our prior written consent. Personal, non-commercial use of the Site (for example, viewing pages, submitting a single application) is permitted.

10. Third-party services and links

The Site uses or links to third-party services including Web3Forms (form processor), Google Maps (embedded map), Google Workspace (email), and Cloudflare (hosting and security). Use of these services may be subject to those providers' own terms of service and privacy policies. We are not responsible for the practices or content of third-party services.

11. Disclaimers

We do not warrant that the Site will be uninterrupted, error-free, secure, free of viruses or other harmful components, or that defects will be corrected. Your use of the Site is at your own risk.

Information on the Site, including service descriptions, statistics, and stated benefits, is provided for general informational purposes and may change without notice.

12. Limitation of liability

To the fullest extent permitted by law, GH Transportation LLC and its owners, officers, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, revenue, data, goodwill, or business opportunities — arising out of or related to your use of the Site, even if we have been advised of the possibility of such damages.

Our total liability for any claim arising from or related to the Site (excluding liability under signed transportation contracts, which is governed by those contracts and the Carmack Amendment) shall not exceed one hundred U.S. dollars ($100.00).

Some jurisdictions do not allow the exclusion or limitation of certain damages, so portions of this section may not apply to you. Nothing in these Terms limits liability that cannot be limited by law.

13. Indemnification

You agree to indemnify and hold harmless GH Transportation LLC and its owners, officers, employees, agents, and affiliates from any claim, demand, loss, liability, damage, or expense (including reasonable attorneys' fees) arising out of:

• Your violation of these Terms
• Your violation of any applicable law or regulation
• Your submission of false, misleading, or fraudulent information through the Site
• Your infringement of any third-party rights through your use of the Site

14. Governing law and disputes

These Terms are governed by the laws of the State of Connecticut, without regard to its conflict of laws principles. Federal motor carrier law applies where preemptive.

Any dispute arising from or relating to these Terms or your use of the Site shall be brought exclusively in the state or federal courts located in Fairfield County, Connecticut, and you consent to the personal jurisdiction of those courts.

Nothing in this section affects the venue, choice of law, or dispute resolution provisions of any signed transportation contract, which control over these Terms with respect to freight movements.

15. Changes to these terms

We may update these Terms from time to time. Material changes will be posted on this page with an updated effective date. Your continued use of the Site after changes are posted constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, please discontinue use of the Site.
